We handle Subsequent Injury Trust Funding cases for injured employees. SIBTF is a fund that provides extra compensation for injured workers who suffered a prior condition or injury. If you have a history of work-disabling disability or disease before you were injured at work, you may be entitled to receive extra compensation in addition to workers’ compensation benefits.
We have dedicated an entire department to our SIBTF cases. We are trained in the complexities involved with litigating SIBTF cases and will be ensuring we maximize your recovery.
SIBTF is a fund that was established in 1945 and is administered by the State of California Division of Workers’ Compensation. It provides additional income to persons injured in the workplace who already have a preexisting condition. SIBTF was designed to encourage employers to hire disabled and impaired workers.
The eligibility requirements for SIBTF are quite complex, but we are here to help you navigate them. In general, you may be eligible if you have evidence of a preexisting disability or impairment at the time of your industrial injury and if the combined effects of all your disabilities cause at least 70% permanent disability.
Almost any preexisting condition can be considered, including a congenital or developmental disease. We will go through your history in detail with you to assess whether your specific conditions warrant further action. Some examples of qualifying pre-existing conditions are:
Prior industrial injuries
Prior civil cases with injury
Cancer
Surgeries
Herad or cardiovascular issues
High blood pressure
Psychological Diagnosis
Hearing Loss/Issues
Diabetes
Auto-immune diseases
Orthopedic injuries or disorders
Internal conditions including circulatory or gastrointestinal diseases
These are very different than your industrial injury claim. Verdieck Chambers assists in completing a detailed medical history to assess your eligibility and how best to pursue discovery. You will then have to attend one or more medical legal evaluations with a Qualified Medical Evaluator. Once discovery is completed, we will either litigate your case or negotiate a settlement on your behalf. We update you with any major developments. SIBTF does not have the same time deadlines for medical reports as a workers’ compensation case. So, these cases can take longer. Be patient, it should be worth the wait.
